1. The Participant must notify the MLS in writing if he does not want to permit
display of his listings on a blanket basis or on a listing-by-listing basis on other
brokers web sites. If a Participant refuses to permit the display of his listings,
then that Participant may not download or frame the aggregated MLS date of other
Participants.
2. The right to display other Participants listings is limited to
Participants (brokers) only.
3. Access to the Kerrville MLS database of current listing information or any
part of such databases is restricted to Kerrville MLS Participants.
4. The display of confidential information fields intended for cooperating
brokers rather than consumers is not permitted.
5. Each listing displayed is required to identify the listing firm.
6. The information that is downloaded may not be modified.
7. The source of the information being displayed must be indicated and the
Participant must refresh all downloads and data at least once every seven (7) days.
8. Only properties listed on an exclusive right to sell basis may be downloaded
and/or displayed.
9. Only active listing information may be displayed.
10. The following fields of information must be displayed on a Participant's web
site.
12. On a one-line view the name of the listing participants must appear
immediately adjacent to the listing information and the type and style must be as large as
the type used in the listing information.
13. Data from different sources other than the Kerrville MLS must be searched and
displayed separately.
14. The fees that will be accessed to each office that requests the data to be
downloaded to their site will be determined before November 1, 2001.
15. Any non-compliance of the above rules or misuse of data will result in the
